Howard Stern Sees Court Case Dismissed

STERN LOSES ONE: Howard Stern’s lawsuit against his employer SiriusXM, originally filed in March 2011, claming the shock jock hadn’t been adequately paid for the subscriber growth at the company after it merged with XM, has been dismissed “with prejudice” by New York State Supreme Court Judge Barbara Kapnick, who granted the satellite radio company's motion for summary judgment. That means the suit cannot be re-filed. The matter mainly turned on the interpretation of Stern's compensation based on subscriber numbers. Stern claimed breach of contract, but the court ruled in favor of SiriusXM, saying that Stern can't count the additional subscribers brought in by the 2008 acquisition of rival XM.
